Terms of Service

These terms are an agreement between ATOM SCALE ("ATOM SCALE," "we," "us") and the business or person creating an account ("you," "your workspace"). By creating an account or using ATOM SCALE, you agree to these terms. If you're accepting on behalf of a business, you're confirming you have the authority to do so. See also our Privacy Policy, which these terms incorporate by reference.

1. Agreement to these terms

ATOM SCALE is software African SMEs use to run their operations — inventory, orders, customers, deliveries, credit, and purchasing — from one place. These terms apply to atomhq.work and every ATOM SCALE application built on it, for as long as your workspace is active.

2. Accounts & who they belong to

An account belongs to a business, not an individual. The person who creates it becomes its first Super Admin and can invite staff, who get their own sign-in but act within that business's workspace — see our Privacy Policy, Section 1, for how that split works for data.

  • You're responsible for keeping your password secure and for activity that happens under your account.
  • A Super Admin is responsible for who they invite and what access they grant — we don't vet individual staff members.
  • Tell us right away at support@atomhq.work if you believe an account has been compromised.

3. Acceptable use

You agree not to:

  • Use ATOM SCALE for anything unlawful, fraudulent, or to store data you don't have the right to hold.
  • Try to bypass access controls, scrape or extract data at scale outside the product's own export features, or interfere with the service's normal operation.
  • Use another business's workspace, or another person's account, without authorization.
  • Reverse-engineer the software beyond what applicable law allows.

We can suspend an account that's actively being used this way, and will tell you why when we do.

4. Your data

The business data you enter into ATOM SCALE — your customers, orders, inventory, financial records, and uploaded files — belongs to you. We don't claim ownership of it, and we don't use it to train any model shared across other customers' workspaces.

You're responsible for having the right to enter data about your own customers, staff, and business into the product — see the Privacy Policy's Section 1 on the distinction between account data (which we're responsible for) and business data (which you are).

5. Fees

ATOM SCALE is currently free during early access — no card required to create an account. If we introduce paid plans, we'll tell you the price and billing terms before you're ever charged, and any plan that renews automatically will come with a reminder ahead of the renewal and a way to cancel from within your own workspace — the same one described in Section 7, not a support request.

6. AI features

ATOM SCALE's Purchasing module analyzes a business's own historical order volume and current stock to suggest how much to reorder. It's a statistical calculation over your own numbers, not a conversational AI — every recommendation is a suggestion a person reviews before anything is purchased. We don't currently offer a chatbot or generative-AI feature anywhere in the product. If that changes, these terms and our Privacy Policy will be updated first, not after, and will describe what data it uses and how it's meant to handle a sensitive conversation.

7. Closing your workspace

A Super Admin can close their own workspace at any time from Admin → Settings, in one step — no support request needed. Closing it immediately removes every team member's access. It doesn't delete your data outright; we keep it for a reasonable period afterward for legal, tax, and dispute purposes, per the Privacy Policy's Section 7, and can permanently delete it sooner on request.

We can also suspend or close a workspace for a real violation of Section 3, or if required by law — where practical, we'll tell you why and give you a chance to export your data first.

8. Disclaimers

ATOM SCALE is provided "as is." We work to keep it accurate and available, but we don't guarantee it will be uninterrupted, error-free, or fit for a purpose we haven't specifically agreed to. You're responsible for verifying figures that matter before acting on them financially or legally.

9. Limitation of liability

To the extent the law allows, ATOM SCALE isn't liable for indirect, incidental, or consequential damages arising from your use of the product, and our total liability for any claim is limited to what you've paid us for the service in the 12 months before the claim arose — or, while the product is free during early access, a nominal amount, since no fees have been paid. This doesn't limit liability where the law doesn't allow it to be limited, including for our own gross negligence or willful misconduct.

10. Indemnification

You agree to cover reasonable costs we incur from a third-party claim arising from your misuse of ATOM SCALE, or from data you entered that you didn't have the right to hold, to the extent that claim results from something you did rather than something we did.

11. Governing law

These terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-law rules.

12. Disputes & arbitration

Read this section carefully — it affects how a disagreement between you and ATOM SCALE gets resolved.

Most concerns can be sorted out by writing to support@atomhq.work first, and we'd genuinely rather resolve it that way. If a dispute can't be resolved informally within 30 days, it will be settled by binding arbitration rather than in court, under the Arbitration and Mediation Act 2023, before a single arbitrator, seated in Lagos, Nigeria, with proceedings conducted in English. The arbitrator's decision is final and enforceable in any court with jurisdiction.

Both you and ATOM SCALE waive the right to bring a claim as part of a class, consolidated, or representative action.Disputes are resolved individually, not combined with anyone else's.

This arbitration agreement doesn't apply to:

  • A claim that qualifies for small-claims court, brought there instead.
  • Either party seeking an injunction to stop misuse of data, intellectual property, or confidential information — waiting months for arbitration wouldn't undo that kind of harm.

You can opt out.If you don't want this arbitration agreement to apply, email support@atomhq.work within 30 days of creating your account, from the email address on the account, saying you're opting out of arbitration. Opting out doesn't affect anything else in these terms, or your ability to use ATOM SCALE.

13. Changes to these terms

If we make a material change, we'll update the date at the top of this page and notify account admins directly before it takes effect. Continuing to use ATOM SCALE after a change takes effect means you accept it.
